Protecting Our Nation's Heritage

First, we represent 51 Members of Congress in The Freedom From Religion Foundation v. The Congress of the United States before the U.S. District Court in New Hampshire.  At question was the constitutionality of the words “under God” in the Pledge of Allegiance.  As you may know, Congress added this phrase to the Pledge in 1954.  Fortunately, just last week, the Court agreed with our brief and dismissed the case. You can read more about this case here and you can read our amicus brief in the case here. 

We are also representing 15 Members of Congress at the Supreme Court of the United States in Salazar v. Buono, which will be heard this Wednesday, October 7th.  At issue is an 8-foot cross that is part of a WWI war memorial in the middle of the Mojave Desert.  Congress has conveyed the land in question to private ownership to avoid any question of an Establishment Clause violation, and yet the challenge remains.  Our brief demonstrates that Congress acted appropriately and that there is no violation of the Establishment Clause.  You can read more about the case here and you can read our amicus brief here.

And, finally, the case of The Freedom From Religion Foundation v. Ayers, which is pending before the U.S. District Court for Western Wisconsin.  This case challenges the Congressional directive that the newly constructed U.S. Capitol Visitors Center includes engravings of the Pledge and the National Motto, “In God We Trust.”  We will soon file a brief in this case on behalf of more than 20 Members of Congress.  This brief will defend the congressional act as entirely appropriate, and in fact historically significant.  Just last week, the Capitol Visitors Center unveiled the new engraving of “In God We Trust.”  This is a significant victory for both the Pledge and the National Motto.
