Americans United for Separation of Church and State v. Prison Fellowship Ministries, Inc. (U.S. Court of Appeals for the Eighth Circuit):
The Iowa Department of Corrections contracted with Prison Fellowship
Ministries (PFM) and InnerChange Freedom Initiative (IFI) to provide a
faith-based rehabilitation program for prisoners in Newton, Iowa.
Americans United challenged the program on Establishment Clause
grounds. The federal district court struck down the program and
ordered PFM and IFI to repay the state prison system over $1.5 million
in payments received. Iowa appealed, as did PFM and IFI.
The ACLJ filed an amicus brief in the Eighth Circuit on behalf of
itself and several former prisoners who benefited from the IFI program,
arguing that Americans United lacked standing to seek an order
compelling one third party to pay another. The case is pending
before the Eighth Circuit.
