Summum v. City of Duchesne (U.S. Court of Appeals for the Tenth Circuit):
A fringe religious group is suing the city of Duchesne, Utah, to force
it to permit display of the group’s “Seven Aphorisms”
monument. The group believes that it has right to display its
monument because of the city’s display of the Ten
Commandments. The ACLJ is representing the City.
Plaintiff’s appeal is pending in the 10th Circuit. Oral
argument is scheduled for November 15, 2005.
Summum v. Pleasant Grove (U.S. Court of Appeals for the Tenth Circuit): The same group as in the
Duchesne
case above is suing a different Utah town, claiming that Pleasant Grove
violates the group’s rights by refusing to display a
Summum’s monument in a park which contains a Fraternal Order of
Eagles Ten Commandments monument. The ACLJ’s defense is
that the Eagles’ monument has been displayed pursuant to
viewpoint-neutral criteria limiting such displays to groups with the
same historical relevance to the town. We are representing the
City. Plaintiff’s appeal from this ruling is scheduled for
November 15, 2006.
